Terms of Use and Service Agreement

1. Introduction

Welcome to Aequus Play (“Aequus Play Limited,” “Aequus Play,” “we,” “us,” or “our”). These Terms of Use and Service (“Terms”) govern your access to and use of the Aequus Play platform and related services (the “Platform”).

The Platform allows users to host and participate in skill-based gaming competitions (“Competitions”) to earn virtual rewards (“Coins”) that may later be converted into cash through approved payment channels.

By creating an account or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy and Cookie Policy (collectively, the “Agreement”).

If you do not agree, you must not access or use the Platform.

4. Nature of the Platform

Aequus Play offers skill-based competitions only. Success in any Competition is determined solely by the user’s skill, knowledge, or performance—not by chance or random outcome.

No form of gambling, betting, or lottery is offered or permitted on the Platform.

Coins won in Competitions can be converted into cash and withdrawn using approved payment processors. Conversion and withdrawal are subject to applicable fees, verification, and compliance checks.

5. Coins, Payments, and Fees

5.1 Coins

• “Coins” are virtual tokens used within Aequus Play.
• Coins hold no inherent monetary value outside the Platform.
• Coins may be purchased, won, or earned and may later be redeemed for cash through approved withdrawal methods.

5.2 Platform Fees

Aequus Play charges a 6% platform fee on all deposits, withdrawals, or cash-convertible transactions. Third-party payment processors may charge additional fees beyond our control.

5.3 Withdrawals and Verification

All cash withdrawals are processed through third-party payment processors that handle KYC (Know Your Customer), AML (Anti-Money Laundering), and fraud checks.

Withdrawals may be delayed or denied if verification fails or if you are located in a restricted region. Aequus Play is not responsible for any errors, delays, or restrictions imposed by payment processors.

6. Third-Party Payment Processing

Aequus Play does not store or process card or bank information. All payments, deposits, and withdrawals are managed by regulated third-party processors.

You agree to comply with their respective terms of service and verification requirements. Failure to complete verification may result in account suspension, withdrawal cancellation, or forfeiture of funds.

7. Regional Restrictions

Skill-based competitions are not lawful everywhere. You are solely responsible for ensuring your participation complies with the laws of your country or state.

8. Location Verification and User Responsibility

8.1 Self-Certification

When registering, you must declare your country and city/state of residence.Access to Competitions will be automatically restricted based on your self-declared location.

8.2 User Liability

You are solely responsible for providing accurate information.

If you falsify your location, use VPNs, proxies, or other tools to bypass restrictions, you are personally liable for any legal or financial consequences.

Aequus Play shall bear no liability for false declarations or unlawful participation by users. Any misrepresentation constitutes a material breach of this Agreement.

8.3 Enforcement

This list may be updated periodically without notice. By using the Platform, you represent and warrant that you are not accessing from or residing in a restricted jurisdiction.

9. Account Conduct and Fair Play

• Engage in cheating, exploiting, collusion, or manipulation of Competitions;
• Create multiple accounts or impersonate others;
• Attempt to reverse engineer, hack, or disrupt the Platform;
• Post unlawful, offensive, or infringing content.

Violations may result in immediate suspension, forfeiture of funds, and legal action.

10. Termination and Suspension

Aequus Play may, at its sole discretion, suspend or terminate your account without notice if:

• You breach these Terms;
• You provide false or misleading information;
• You fail KYC/AML verification;
• You attempt to access from a restricted jurisdiction; or
• Required by law or payment partner policy.

Upon termination:

• Your right to use the Platform ceases immediately;
• Outstanding funds may be withheld pending verification or investigation.

11. Taxes

You are solely responsible for reporting and paying any taxes, duties, or levies applicable to your use of the Platform or any winnings received.

Aequus Play does not provide tax advice and is not liable for your tax obligations.

12. Intellectual Property

All content, software, trademarks, and designs on Aequus Play are the exclusive property of Aequus Play Limited.

You may not copy, modify, reproduce, or exploit any material without prior written consent.

Unauthorized use may result in legal action.

13. Disclaimers and Limitation of Liability

The Platform is provided on an “as is” and “as available” basis. Aequus Play makes no warranties, express or implied, regarding:

• Availability, reliability, or error-free operation;
• Accuracy of content;
• Suitability for any specific purpose.

To the maximum extent permitted by law, Aequus Play shall not be liable for:

• Any indirect, incidental, or consequential damages;
• Any loss of funds due to user misrepresentation, technical issues, or third-party service failures;
• Any damages exceeding the total fees paid by you in the preceding six (6) months.

14. Indemnification

You agree to indemnify and hold harmless Aequus Play Limited, its directors, employees, affiliates, and partners from any claim, liability, damage, loss, or expense (including legal fees) arising from:

• Your use of the Platform;
• Breach of these Terms;
• Misrepresentation of location or eligibility;
• Violation of applicable laws or third-party rights.

15. Data Protection and Privacy

We process personal data in accordance with the UK GDPR and other applicable data protection laws. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed under the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer rights apply.

Users outside the UK agree that it is their sole responsibility to ensure their use of the Platform is lawful in their jurisdiction.

17. Amendments

We may update these Terms at any time.
Changes take effect upon posting on our website. Continued use of the Platform after changes indicates acceptance of the updated Terms.

18. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Aequus Play Limited regarding your use of the Platform.
